What does BAC stand for?

How does a breath test work?
Law enforcement agencies use the Intoxilyzer 8000 to determine BAC. You should be asked to take out any dental pieces that can be removed and to rinse your mouth out. The police officer or other law enforcement agent also has several other important steps that he or she must take in order to maximize accuracy. The machine is set for an average male’s lung capacity and requires that the suspected individual blow a deep breath into a tube, in which filters will measure the alcohol content in your breath. Breathalyzer machines are widely accepted to be fallible when used at all incorrectly. Additionally, they are not able to calculate properly based on different body composition, lung capacity and other similar factors.
What is the DHSMV hearing?
After you have been arrested for drunk driving, you then have ten days to schedule a hearing with the Department of Highway Safety and Motor Vehicles (DHSMV) in which the future of your license will be determined. This is not the same as your criminal trial and, in fact, is purely administrative and does not have anything to do with your criminal charges. Your attorney can still fight for your right to drive in this hearing.
