Errors in Blood Testing for DUI
When a driver is arrested for DUI, law enforcement may administer a breath or blood test to determine whether his or her blood alcohol concentration is above the legal limit. If a driver has a blood alcohol level of .08% or greater as determined by one of these tests, he or she may be charged with DUI.
A blood test is considered to be a more accurate form of blood alcohol testing, but there are still errors or faults that may lie with this form of chemical testing. A blood sample must be taken by a qualified professional and must be handled properly. In addition to demanding an independent analysis of the sample, a DUI lawyer may be able to question such issues as:
- Whether the right amount of preservatives were added to the sample to ensure it was properly stored
- Whether the sample itself may have been contaminated at the time the blood was drawn or shortly thereafter
- Whether the person who took the sample shook it to ensure that the anticoagulants and preservatives were properly mixed with the blood
- Whether there was an error in the evaluation of the sample
